Advancing on December 23, 1861, Col. James A. Garfield led an expedition of over 2000 federals from Louisa toward Paintsville with the intention of driving Humphrey Marshall's Confederate force out of Kentucky. Monitoring the federal advance, Marshall posted his line of battle on the hills along Middle Creek to receive them. Garfield's force appeared about 10 am, but dispositions were not made and fighting did not begin until noon.
According to Marshall, Thomas' and Clay's companies were dismounted and posted on the Confederate left on the opposite side of the creek along heights commanding the plain of Middle Creek. Jeffress' four guns, supported by the 54th VA, Witcher, and Holliday, held the center. The 5th KY and 29th VA comprised the right of Marshall's line.
Three volleys from Jeffress' artillery scattered an early advance of Union cavalry on the center. They were not seen again, at least in mounted formation. The troops on the left were never threatened, and never fired a shot. Most of Garfield's efforts were against the Confederate right. Attesting to a supply of faulty artillery ammunition, Garfield stated that many of the Confederate shells did not explode.
The engagement lasted some four hours until Garfield withdrew down the creek, through Prestonsburg, and back to Paintsville from whence they had come. Garfield reported a successful campaign after retreating to the safety of Paintsville. He estimated Confederate losses at 60-85 killed besides the wounded. Marshall claimed victory, along with severe federal casualties, up to 550, well beyond their official reports. The casualties, as officially reported by each side, were 10 Confederates killed and 14 wounded; 2 federals killed and 25 wounded.
After pursuing Garfield a short distance, Marshall likewise retreated deeper into Floyd County starting the next day, in search of subsistence, which was scarce in the mountains that winter season. Also noteworthy, Marshall said that there were no overcoats and few blankets in the command.

"Vile Miscreant" Sylvester Manning 1874 Letter

Letter, 30 March 1874

Written by Isabella (Belle) HARPER BERTRAM to her sister Sarah (Salie) HARPER LYON in 1874. In it she tells about the fascinating pursuit and capture of a "vile-looking miscreant", Sylvester Manning. Belle is a widow. Her husband Peter Bertram was killed at the battle of Shiloh. Amelia/Miel is her sister, Amelia HARPER. Alec is the name of Amelia's husband and her son. Unfortunately only one page of the letter survives.

Dear Sallie,

We have got trace of the goods and have arrested some of those concerned in the business. Ten horses were stolen from Tollesboro about ten miles from here, and a constable, Hiram Warder accompanied by Nat. Toll went in pursuit forthwith and were only about 6 hours behind. It so happened that one of the horses had on a peculiar shoe, easily distinguished from all other tracks and they got on the trail which they kept day and night without difficulty. They found the place where they stopped, and the first thing they saw was the horses. A girl was standing in the yard, who vanished the instant she saw them and in a few minutes two men came out and made for the hills. They rode up to the door asked for their dinner and asked to buy cattle. After a good while finding the men did not return, they told their errand plainly, took possession of the horses, the saddle packets, and overcoats, which were hanging out in the yard to dry (it had been raining), and came home. Of course I can't go into the particulars of their trip. It was hazardous, and exciting, but accomplished in safety. There in the saddle packets was found a pair of shoes stolen from us.

We had sent such samples of the goods as one happened to have to reliable parties and a careful description of the boots and shoes, and this was the very first clue, away in Wayne Co, Virginia.

Late one night Const. Warder made his appearance with the shoes which belonged to us, and so next morning he & Aleck started—Warder armed with carbine and revolver. Mr. Varian's store in Orangeburg had been robbed of several hundred dollars worth of goods & clothing and the overcoats belonged to him. Aleck & Warder got four others, well armed with pistols and at Vanceburg and started to some place in Black Oak Bottom above Vanceburg called Spy Run, made a descent on several houses, found women with dresses on made out of our gingham, found men with the boots on, and different things. They followed up the line of development, went over the river, arrested Sylvester Manning, a vile looking miscreant, and probably one of the ringleaders, and had a preliminary examination at Vanceburg, and pending other parties implicated made another descent on one Tad Harens, supposed to be respectable and found a quantity of our goods, 50 lbs. coffee, ready made dresses... Downe Court Manor Statutory Listed – Grade 11

There is an early deed referring to Downe Court Manor dated 1287.  The present building dates from around 1690. Years ago it was surrounded by ponds which tend to suggest the original manor house could have been moated.  Sir Thomas Mervyn owned the house in 1518 and was Lord Mayor of London. When he died he left one penny to each prisoner in the London gaols. One time owner was Sir Thomas Smyth who was governor of the East India Company and Treasurer of the Virginia Company.

Another owner was Henry Manning Marshal of the Household under Henry V111 and Queen Elizabeth is believed to have attended the christening of his daughter Margaret in 1559.  Parish Register records the ceremony took place ‘after ye Queene’s visitation’.

Then came Jacob Verzillini an Italian from Murano, near Venice who took over a glass-making factory in Crutched Friars in London around 1571.  He was granted a 21 year licence to make drinking glasses providing he taught his skills to Englishmen and did not import the glasses.

He was very successful and bought quite a lot of property in the area. There may be as many as nine of his glasses remaining.  V and A has one so does the British Museum. Windsor Castle and another at Cambridge and several are abroad.  One was dropped at auction.  When he died he bequeathed ‘cloth to 6d a yard for a new coat for all villagers to attend my funeral’.

Downe Hall –Locally Listed

There has been a building on this site since 1290.  Originally named after Richard Godarde the building was named ‘Goddards’. Sold to the Manning family in the 14th century.  It was originally of flint and stone and some windows were made of horn.  The Mannings were the oldest and most distinguished family in Downe. Some were among the first to emigrate to America where even today there is the Manning Association.

According to the Hearth Tax in 1645 there were 8 taxable hearths.  The largest number in the village.  After the Carew family came the Sandys, the last of whom died in 1694, and in 1698 Sandys widow married the Earl of Eglintoun – she was 96 at the time.

In 1820 the house burned down and the present building erected.  One time owned by the Lubbock family it has been considerably restored in recent years.

THE MANOR OF DOWNE-COURT, with the scite of it, in the reigns of king Edward I. and II. was the property and residence of Richard de Downe, who lies buried, with his wife Margery, in the chancel of this church, but without any inscription on his grave stone, the brass having been torn from it. This family was extinct here before the middle of the next reign of king Edward III. when the Petle's of Trowmer, in this parish, were become lords of it. John Petle of Trowmer, esq. died possessed of it in the 18th year of king Richard II. in whose descendants this manor continued down to John Petley, esq. (for so the name began now to be spelt) who lived in the reign of king Henry VIII. He died without male issue, leaving by Christiana his wife, daughter and heir of Thomas Philipott, four daughters his coheirs; John Petle, the ancestor of this family, was settled at Downe, in the reign of king Henry III. and bore for his arms, Argent, two bends ingrailed, a canton sable. His son, Richard, left two sons, of whom John, the eldest, was possessor of Downe manor, in the reign of king Richard II. as above mentioned; and Richard left two sons, John, ancestor to those of Halsted, now extinct, and William, ancestor to those of this name seated at Filston, in Shoreham, now likewise extinct, and those of Riverhead, in Sevenoke, now remaining there. John Petle, eldest son of Richard, married Juliana, daughter and heir of William Troumer of Downe, by whom he had Thomas Petle, who died in the 9th year of king Henry V. and lies buried with Isabel his wife, in this church. His son, John Petle, married Alice, daughter and coheir of James Brampton, by whom he had John Petley, who lived in the time of king Henry VIII. and left four daughters his coheirs, as above mentioned. (fn. 1) Of whom Agnes, the eldest, was married to John Manning, esq. of Downe, who, on the division of their inheritance, became en titled to it. (fn. 2) He was descended from John Manning, who was of Cowdham, and died in the 14th year of king Henry IV. leaving John Manning, his son, who by Juliana, daughter and heir of Richard Brockhill, had Hugh Manning of St. Mary Cray, who married the daughter of Sir William Brandon, by whom he had two sons, of whom Richard, the youngest, settled at St. Mary Cray, where his posterity continued till within these few years; and John Manning, the eldest, married Agnes Petley, as above mentioned. (fn. 3) He died possessed of it in the 35th year of king Henry VIII. and lies buried with Agnes his wife in this church. His descendant, Peter Manning, esq. of Trowmer, in the reign of king James I. alienated this manor to Palmer, and in 1657 it was in the possession of John Palmer, whose son and heir, Michael Palmer, in 1662, sold it to Mr. Richard Glover, from whom it descended to Mr. Richard Glover, merchant of London, whose daughter marrying James Gladhill Vernon, esq. intitled him to the possession of it, and he is the present owner of it.

But the seat itself, formerly called DOWNE-COURT, but since DOWNE-HALL, which passed, together with the manor, to John Manning, in right of his wife Agnes, one of the daughters and coheirs of John Petle, as before mentioned, was, by his son, Henry Manning, esq. of Greenwich, separated from the manor, and sold by him to Sir Francis Carew of Beddington, in Surry, who some time afterwards alienated it to Mr. Ellis of London; from whom it passed by sale, in the reign of king Charles I. to Col. Richard Sandys, third son of Sir Edwyn Sandys of Norborne; the second son of Dr. Edwyn Sandys, archbishop of York, by Cicely, daughter of Thomas Wilsford of Cranbrooke. Henry Sandys, the eldest son of Richard above mentioned, by Hester his wife, daugh ter of Edwin Aucher, esq. of Wilshorough, was of Downe-court, and married Catherine, widow of Sir John Kay, bart. and daughter of Sir William St. Quintin, bart. by whom he had Jordan Sandys, esq. who passed away Downe-court, by sale, to Rich. Oldner, esq. of Exton; and he a few years ago alienated it to Thomas Omer, esq. who left it by will to his grandson, Thomas Omer, esq. the present owner of it.

John Burnett was christened 25th of December 1610 at St. Nicholas Church in Aberdeen, Scotland and died February 1686 in Old Rappahannock County, Virginia, age 76.He was buried at the Burnett Plantation Cemetery in Virginia.

Some have the parents of Thomas listed as John, born abt 1548, and Isabel Burnett, married in 1573 in St. Nicholas Parish, Aberdeen, Scotland


The most asked question is, “Did our Burnetts descend from the “Burnet of Leys” or the “Burnet of Barns?” The answer is most likely the “Burnet of Leys.” The Barns family inhabited the southern region of Scotland in Burnetland and the Leys family in the north. Our John was a man of wealth and importance to be commissioned by Charles I, King of Great Britain, France and Ireland.

On the 13th of March, in the year 1638, King Charles I granted a Charter to John Burnett, a Commission To Trade In Virginia, to wit: “Warrant from the King to the Governor of Virginia or other officers whom it may concern for JOHN BURNETT of ABERDEEN the SOLE MERCHANT OF OUR KINGDOM OF SCOTLAND that hath supplied the plantations of Virginia and become our tenant there and his factors to have free commerce and traffic between Scotland and Virginia upon paying the usual customs and entering into bond to unlade [unload ship] anywhere other than in the ports of Scotland.”

So, John Burnett was a Merchant of Aberdeen and had previously supplied the plantations of Virginia with goods from Scotland and England and on the return trips, carried cargoes of tobacco to Great Britain. The wording of the above warrant suggests that King Charles I, trusted John Burnett to stand with him as “His Tenant and Sole [only] Merchant to the American Colonies. What an honor! John Burnett loved the king and named a son after him. John also named a son THOMAS after his father and another son was named JOHN (II) after his grandfather..

The Johnstons of Aberdeen were a family of wealth and influence and was greatly connected to the Burnetts. Not only was John Burnett’s mother a Johnston, but he was married to Lucretia Johnston. Lucretia was christened in St. Nicholas Church on 22 March 1629 and died Oct 1709 in Essex County, Virginia and named her second son, Thomas as her heir. Among items listed in her estate inventory was yardage of “Fine Scotch Linen” and various types of gowns, including a “riding gown, a tamine gown and a head-dress with yellow lace and a yellow top knot on it.” She bequeathed the latter to her daughter-in-law, Amy Gatewood Burnett. Her son John II owned a violin.

Manning is a family name. Manning is a family surname which is particularly prevalent among those of Irish descent.The Manning family descends from the 37th King of Ulster, North-East Ireland, who ruled until around 450 A.D. This King was very wealthy and was, therefore, called the Maoin, which translates as riches or wealth. The Clan of Maoin was said to have been converted to the Catholic faith by Saint Patrick himself. Sometime between the 10th and 13th centuries many of the Maoins crossed the English Channel and settled in Southern England on the Kentish Coast and, according to English Law, they were forced to give their name an English form: they chose Manning, others chose Mannion. Manning is also the name of a Galway family who were formerly chiefs of Sodhan, a district nearly co-extensive with the barony of Tiaquin. O'Mainnín, Kind of Sodhan, is mentioned in the Chronicon Scotorum as early as the year 1135, and the O'Mainnins continued to form a distinct clan down to the time of James I of England. The chief resided at Menlough Castle, in the parish of Killascobe, Galway. In 1617, Hugh O'Mannin surrendered his estates, but a small portion of it was restored under the Act of Settlement in 1676 where the name is still common in Galway and Roscommon, and has spread into other parts of Ireland.

John Mannen listed as a Mason County Distiller of Whiskey in 1797

Taxation on whiskey was a controversial topic in early America, especially on the frontier, which, in the late 17th century, of course included Kentucky. Look up “Whiskey Rebellion” on Google to read a lot more about it. The law taxing whiskey passed in 1791, and it was not until 1798 that one William Clarke, a federal attorney, began prosecuting those who hadn’t paid the tax. The court docket gives us the names of lots of folks in the whiskey distilling business in those early days. Keep in mind that Mason County is much larger during this time than it is now!

The 1810 census in Kentucky lists a John Mannen in Mason Co.

On 22 Sept. 1812, John Mannon and Thomas T. Worthington served as witnesses for the will of John Watson. Note that a Thomas Mannen married Thomas Tolley's daughter Rachel; she was born in 1800. I've seen his birthdate listed, unsourced, as 1798. Note that a Thomas Mannen exists, aged 51, married to a Susan, aged 42, in the 1850 census for Mason Co. The fact that Mannon and Worthington appear together here suggests a family relation.

A John Mannen married Charity Critchfield (Crihfield, Crhfeld) in Mason Co. in 1814. A sergeant "John Mannan" served in Capt. Dowden's company of Pogue's Kentucky Volunteers in the War of 1812; he enlisted Aug. 27, 1812 to Sept. 26, 1812. Another "John Mannan" served as a private in Robert Crutchfield's detachment of the Virginia Militia (a pretty big coincidence with the marriage of 1814!). A Thomas H. Mannen also served in 1812, in the 40th Kentucky regiment, as a Major.

In 1819, a John Mannen is listed as leaving an estate in Mason Co., and as having left a will. (Is this supposed to be 1822--as below?)

The 1820 Census from Mason Co, Kentucky seems to be key here, though without further help it's just a list of names. There are several groups living near each other: Jas Pollock, Jos Pollock; and then several lines later, all as heads of household: Jno Mannon, Sra Perkins, Jas Mannon, Jno Mannon Jr. What might help, if it is possible, is to look at deeds for land.

A John Mannen Sr. died in in 1822. His will lists the following as his family, including John Sr. and eight children; no wife is named (presumably she pre-deceased him):

The Mannings of South Carolina

Laurence Manning (1757-1804) was wounded during the Battle of Long Island in 1776. His widowed mother was with him. Nothing is known of her except that she and Laurence came from Carlisle in Pennsylvania. He was a soldier in the continental Army. Was promoted to Sergeant in 1777; to Ensign in 1778; to Lieutenant and Adjutant in 1779. In 1780 he was transferred to the Brigade of Light Horse Harry Lee.

After the war he married into a "highly respectable family. He married Susannah Richardson the daughter of General Richard Richardson and his first wife, Mary Cantey.

Laurence and Susannah had a son Richard Irvine Manning I (1789-1836), who was governor of South Carolina from 1824-1826.The portrait is of Richard.

Recent Manning Family Research in Morgan County Kentucky

I researched the records in the Morgan County Clerk's office in West Liberty,Kentucky on April 23,2008 and found the will of my Great,Great,Great Grandfather Charles B. Mannin ( wife Susanna Shubert) who died in 1877.Charles was born in 1799 in Virginia and married Susanna Shubert in Bath County on September 30,1812. (Morgan County was formed from Bath,Floyd and Johnson Counties).Susanna Mannin was shown in the 1880 Morgan County census as 84 and her daughter Polly was shown as residing in the household.

Charles' father Meridith Mannin( a prominent landowner) was born in Virginia in 1780 and lived until after 1850.Meridith married Catherine Burnett in March 1797 in Franklin County,Virginia. Catherine was the daughter of Charles Burnett and Catherine Brock. Burnett's father John came came from Aberdeen,Scotland to Virginia in the 1630s . The Burnett's had a fleet of ships and received a warrant or charter from King Charles in 1638 to trade in Virginia.

Charles' daughter Mary A. Mannin (a/k/a Polly and born around 1840-41) married our Great,Great Grandfather Sylvester Mannin(g) on April 8,1863 just before he enlisted in the Confederate Army.Polly is the name shown on our Great Grandfather Val's death certificate as his mother in 1937. Polly was still alive as late as 1900 as there is a deed to her of part of her father Charles' estate.Val married Mollie Hackworth,second marriage.


It is believed that Sylvester divorced Mary A. (Polly) and was married several times and left children behind as he traveled all over Kentucky and Ohio. It is also believed that he may have been imprisoned for theft and burglary in the 1870s for offenses committed in or near Tollesboro in Lewis County

Sylvester and Polly had three children:

Ephriam Elliott Manning born January 3,1868 ,died in 1926 and is buried in Ezel,Kentucky

Valentine (Val) Manning born May 19,1871,died January 26,1937 and is buried in the Maysville Cemetery not far from his wife Mollie Hackworth Manning,believed to be a Cherokee or at least half Cherokee.

My grandfather Walter Carl "Tuck"Manning (1903-1958)was Val's son. Val manning died during the 1937 flood of Pneumonia and had to be buried twice because of high waters. WC and my father Walter Lee manning,Jr. rowed the body to the Maysville Cem. where it was buried on high ground and later moved to its current location.

WC married June Mae Lacy (1911-1999) of Wolfe County in Morgan County in 1924. Both WC and June are buried in the Maysville Cem. with Val and Mollie.

The Manning's from Morgan County resided in the small community of Ezel on US 460 west of West Liberty,the county seat. Many Manning's are buried in the family cemetery in Ezel and in the cemetery behind the Presbyterian Church.

William H. Manning Grave

I found this grave in Woodsbend,Morgan County,Kentucky last weekend.I believe that William H. is either the brother or first cousin of my great,Great Grandfather Sylvester Manning. Both fought for the CSA and served in the same infantry company.

Simon de Manning, 12th Century

Baron, Knight, Crusader and Lord of the Castle at village of Bertrey.

He was the seventh great-grandfather of Phebe Manning, wife of James Waters of London.According to Walter Nathan Waters in his unpublished notes entitled "The Waters Family of West Sutton, Mass. 1720-1935": Simon de Manning lived about 1230. Quoting Walter: "The first Simon de Manning, said by one authority to be a grandson of Rudolph of Mannheim (970), was the first English baron to take up the cross and go with King Richard I, Coeur de Lion, (1189-1199) to the Holy Wars in the Second Crusade, when he was knighted. He died during the reign of King Henry III (1217-1261).

Simon was the grandson of Gilbert de Maminot, born about 1050, whowas a Norman, a member of William the Conqueror's people who came from Normandy, France.The French invasion of England occurred in 1066 when Gilbert was about 16.Perhaps he fought in the battle for England.

The battle was fought at Hastings in the southern tip of England. Harold, the English king had been up in the northernmost part of England (Scotland) fighting the Norse King. The English King won the battle with the Vikings. Hearing that the French invaders
were raping the English women, he and his English army made a forced march all the way down through England. It's no wonder the Frenchman, William, killed Harold at Hastings. Immediately after their king's death, the English surrendered.

History Of St Mary The Virgin Chuch,Downe Kent Mentions Manning's

1400-1799

The steeple must have been built by the 16th century, because an inventory of 1552 refers to three bells. Two of these made by William Dawe of London (1385-1418) and one, maker unknown, dated 1511. The remaining three were added early this century.

Apart from the previously mentioned lancet window, the other windows were substituted during the Perpendicular period (15th or early 16th century), although they were extensively restored by the Victorians.

The font appears to belong to this period and is undistinguished, probably local work. At some time its stonework has been defaced.

The brass in the nave floor in memory of Tomas Petle and his wife Isabella is undated but probably late 15th century. The Petley family was prominent in Downe between the 13th and 16th centuries and a house in the village is called Petleys.

The Manning family was also numerous and important, and a brass in the nave records the death of John in 1543. Another brass in the chancel shows the family arms and motto and records that Edward, the son of the last Manning buried in Downe, died in 1622 at the age of 20, having been page to Prince Charles, later King Charles I.

During recent repair work, the nave floor was taken up and revealed the broken remains of inscriptions which had covered coffins, now disintegrated. One fragment refers to John Bederenden, a citizen of London, an MP and draper, who died in 1445, although it is not clear why he was buried in Downe.

In 1538, Thomas Cromwell, Vicar General to King Henry VIII, ordered registers of births, marriages and deaths to be kept. In our diocese of Rochester, Downe possesses one of the only ten to survive from this time, although it is now kept for safety with most of the church's old records at Bromley Library.

The Family Of Manning

The family of Manning had their early origin in Germany, and in the 4th or 5th century went from Saxony, in the lower part of that country, to England, where at first the family consisted of three branches, one in County Kent, one in Sussex, and another in Norfolk.

In Kent we find Ranuloph deManning, of Manholm, Lord of Manholm, who married the aunt of King Harold. His son, Simon deManning, was Lord of Betiad at Downe, County Kent. He was the first English baron to go with KingRichard to the crusades in 1190. Simon de Manning is the ancestor of the Mannings of Downe and Cudham, who were knights marshall of the household of England's sovereigns for about 400 years.

The Mannings in Ireland arrived during the reign of Henry II, 1154 - 1189. Sir Henry Manning, knightmarshall to Henry VII, had a grandson, John Manning who had a grant of part of the possessions ofthe Earl of Desmond, in Ireland. In 1600 he joined the Earl of Essex in an expedition to the land of the Irish people.

Branches of the Manning family from England and Ireland emigrated to North America and settled in Nova Scotia, New England, New York, New Jersey,Virginia and the Carolinas.

Mannings are now living all across Canada and the United States.
